1. Agreement to Terms
By accessing or using the services of Advanced Facilities Design Limited Liability Company ("Company," "we," "us," or "our"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our services.
2. Services
We provide professional graphic design services including but not limited to brand identity design, logo design, print design, digital design, marketing collateral, and advertising design. Specific services and deliverables will be outlined in individual project agreements.
3. Project Agreements
Each project will be governed by a separate project agreement or proposal that outlines the scope of work, timeline, deliverables, pricing, and payment terms. The project agreement, together with these Terms and Conditions, constitutes the entire agreement between you and the Company.
4. Payment Terms
Payment terms will be specified in individual project agreements. Generally:
- A deposit is required before work begins
- Final payment is due upon project completion
- Late payments may incur additional fees
- We accept various payment methods as specified in your agreement
5. Intellectual Property
Upon full payment, you will receive ownership rights to the final approved designs as specified in your project agreement. Until full payment is received:
- All designs remain the property of Advanced Facilities Design LLC
- You may not use, reproduce, or modify any designs
- We reserve the right to showcase completed work in our portfolio
6. Revisions
The number of included revisions will be specified in your project agreement. Additional revisions beyond the agreed scope will be billed at our standard hourly rate. Major changes to the project scope may require a new proposal.
7. Client Responsibilities
Clients are responsible for:
- Providing accurate and complete information for the project
- Timely feedback and approvals to maintain project schedules
- Ensuring they have rights to use any materials provided to us
- Reviewing deliverables thoroughly before final approval
8. Limitation of Liability
To the maximum extent permitted by law, Advanced Facilities Design LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to our services. Our total liability shall not exceed the amount paid for the specific project in question.
9. Termination
Either party may terminate a project with written notice. In case of termination, the client is responsible for payment of all work completed up to the termination date. Non-refundable deposits may apply as specified in your project agreement.
10. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of West Virginia, without regard to its conflict of law provisions.
